High Country Design Service Disclaimer/Agreement

 Please do not be discouraged by the amount of notes here, they are pretty much common sense issues but I feel it appropriate to list them to help avoid any possible misunderstandings.

There are a number of items that are not within my control and I cannot be responsible for:

  • Copyright infringement issues regarding submitted content.
  • Submitted content errors, accuracy, etc.
  • Delays in design caused by tardy content submission.
  • Unusable content.  You must submit content in a format that I can use. 
  • Effects on visitor's local hardware/software as a result of viewing, or interacting with website.  Any adverse effects would typically be the result of hacker attacks.
  • Hacker attacks and vandalism resulting from such attacks.  I will of course, repair the site initially at no charge, however if your site is the target of repeated attacks it will require increased security measures and additional costs for such measures.
  • Server downtime/unavailable (i.e. too busy). My affiliated host boasts a 99.9% uptime so downtime should be a very rare occurrence, "too busy" issues are generally resolved simply by retrying a few seconds later (and are also rare).
  • Domain name conflicts.  Choosing an available domain name does not mean that some person or company will not try to stop you from using it in the future.
  • Host server goes out of business.  I do not foresee any problem here, but since I do not personally own the hosting server, I cannot guarantee hosting rates if the host server goes under.  Because of the great rates currently offered, I cannot be sure of finding similar rates with other hosts.  In the extremely unlikely event that my present affiliate host becomes unavailable, I will offer a new hosting package and a credit or refund of hosting costs prorated monthly.
  • I purchase and own the hosting account that you will use.  Your domain name (unless purchased separately) is owned by the server host.  However, as the account owner I do have control over the use of the domain name.  Should you ever wish to host your site elsewhere, the domain name can be transferred to your new site (domain transfer and/or registration fees may apply).  Being tardy with your yearly hosting payment may result in the loss of the domain name. For clients using their business name as their domain I recommend obtaining the domain directly from the registrar in order to have direct ownership.
  • Page appearance across platforms and browsers. Due to the variety of browsers (and versions) in use today, and the user settings available, it is not possible to guarantee that the site will appear exactly as intended in all browsers.  I design primarily for Explorer 4+, and Netscape 4+.  Most of the site will also work in earlier versions but JAVA effects and some other features may not.  We will discuss these issues during the design stages of your site.

Additional Notes:

  • I retain the right to refer to your site as an example of my services, and require the placement throughout your site of text links crediting me with the design of your site.  A typical example would be Site Design by High Country Design placed near the bottom of your pages and visible in the browser window.
  • If you decide to go elsewhere for your site maintenance and updating, I may require that you also host your site elsewhere.
  • In the unlikely event that you decide to seek hosting elsewhere, I will prorate your hosting fee according to the monthly payment schedule. I may require that you also seek maintenance and updating services elsewhere.
  • Should our relationship be terminated, for reasons other than non-payment**, I will provide you with a CDROM or Floppy Disc(s) containing the current version of your site pages and attendant files.  Site pages will be in HTML format and attendant files will be in the format in which they were utilized, i.e. JPEG, GIF, and so forth.      **If termination occurs due to non-payment any physical content materials (discs, papers) that you have provided will be returned, however none of the site content or programming (coding) which I have created or implemented will be provided to you until full payment has been made to my satisfaction.
  • As noted earlier, your Domain name is actually owned by the hosting company where I purchase a hosting account for you.  They provide the use of the name as a service to their hosting client (me).  While I do have control of the name, I do not actually own it. If your Domain name is also your business name, and could not be replaced, I would advise you to purchase your Domain name separately, directly from Network Solutions and Internic.  This is a painless, easy process and I will gladly instruct you how.  You will then be entirely responsible for directly paying your yearly Internic fees on time.
  • To transfer an existing or new Domain name to a hosting account that I provide, I need your Network Solutions account number, password, and your registered e-mail address.  Transferring the Domain does not transfer ownership--you still own it.
